Terms of Service

1. Who you are contracting with
Foundex is operated by Avaunt Business Advisory Private Limited ("Foundex", "we", "us"). By creating an account or otherwise using the Foundex service at foundex.pro (the "Service"), you agree to these Terms of Service.
2. Eligibility and authority
You confirm that you are of legal age in your jurisdiction and, if you are using the Service on behalf of a business, that you have authority to bind that business to these terms.
3. The Service
Foundex provides interactive strategic-guidance tools, business diagnosis sessions, and framework reports for founders and business owners. Guidance is informational and does not constitute legal, tax, investment, or professional advice — you remain responsible for decisions you make.
4. Your account
You must provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for activity under your account.
5. Acceptable use
You must not:
- Use the Service unlawfully, fraudulently, or to send spam.
- Infringe intellectual property rights or applicable law.
- Interfere with the security or integrity of the Service, including introducing malware, probing, or scraping.
- Resell or redistribute the Service, or attempt to reverse engineer or circumvent any technical limits.
6. Intellectual property
Foundex, its software, frameworks, documentation, and branding are owned by Avaunt Business Advisory Private Limited or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan.
7. Your content
You retain ownership of the content you enter into the Service. You grant us a limited licence to host, process, and display that content solely to operate the Service for you.
8. Payments, subscriptions, taxes and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms and our Refund Policy.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time via the customer portal; cancellation takes effect at the end of the current period unless stated otherwise.
9. Service availability
We work to keep the Service running reliably, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose).
10. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, if payment fails, if we reasonably suspect fraud or a security risk, or on repeated or serious policy violations. When your access ends, you may request an export of your data within a reasonable window before it is deleted.
11. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where such liability cannot be limited by law.
12. Indemnity
You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
13. Changes
We may update these terms from time to time. Continued use of the Service after changes means you accept the updated terms.
14. Governing law
These terms are governed by the laws of India, and the courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute, subject to any mandatory consumer-protection rights in your country of residence.
